Terms of Use

These Terms of Use (“Terms”) govern your use of Garden Companion by Wyler (“Garden Companion” or the “App”), provided by Wyler Works (“Wyler Works,” “we,” “us,” or “our”). By using Garden Companion, you agree to these Terms.

1. Garden Companion

Garden Companion provides tools for organizing gardens and properties, identifying plants, recording observations and memories, managing garden information, using camera-based features such as Live Explore and walkthroughs, and receiving AI-assisted gardening guidance.

You may need an account to use some or all App features. You are responsible for maintaining the security of your credentials and activity associated with your account.

4. Subscriptions and Apple In-App Purchases

Garden Companion may offer auto-renewable subscriptions through Apple’s App Store. Available plans, prices, billing periods, and included features are shown in the App and in Apple’s purchase interface before you subscribe.

Payment is charged to your Apple account when you confirm the purchase. Subscriptions automatically renew unless canceled according to Apple’s subscription rules. You can manage or cancel your subscription through your Apple account or App Store subscription settings.

Turning off auto-renewal generally does not remove paid access immediately; access continues through the verified paid period unless Apple reports an earlier refund, revocation, or other change affecting entitlement.

5. Free and Paid Usage Limits

Garden Companion may apply feature, usage, storage, session, or other limits to free and paid plans. Current plan details are shown in the App.

6. AI Features

AI-generated responses, classifications, plant identifications, recommendations, summaries, and predictions are informational tools. They are not guarantees of accuracy or outcomes.

7. Your Content

You retain ownership of photos, notes, observations, garden records, and other content you submit. You grant Wyler Works a limited, non-exclusive right to host, process, reproduce, transmit, and otherwise use User Content as reasonably necessary to operate, secure, improve, and provide Garden Companion.

8. Acceptable Use

• Do not violate applicable law or another person’s rights.
• Do not attempt to access another user’s account or data.
• Do not interfere with, overload, reverse engineer, or compromise App systems except where such restriction is prohibited by law.
• Do not circumvent usage limits, authentication, subscription verification, or security controls.

9. Intellectual Property

Garden Companion, including its software, design, branding, text, graphics, and features provided by Wyler Works, is owned by Wyler Works or its licensors and protected by applicable intellectual-property laws.

10. Third-Party Services

Garden Companion depends on third-party services, which may include Apple, cloud infrastructure providers, authentication providers, AI providers, weather providers, and other service providers.

11. Availability and Changes

We may update, modify, suspend, or discontinue features to maintain, secure, improve, or operate Garden Companion. We do not guarantee that every feature will always be available, error-free, or compatible with every device.

12. Account Deletion and Termination

You may delete your Garden Companion account using the in-app Delete Account feature. Account deletion is permanent and removes associated Garden Companion account data according to our deletion process.

Deleting your Garden Companion account does not automatically cancel an Apple subscription. You remain responsible for managing Apple billing through Apple’s subscription controls.

13. Disclaimers

To the maximum extent permitted by law, Garden Companion is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Wyler Works will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from or related to your use of Garden Companion.

15. Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, and expenses arising from your unlawful misuse of Garden Companion, your violation of these Terms, or your violation of another person’s rights.

16. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except where applicable law requires otherwise.

17. Apple

These Terms are between you and Wyler Works, not Apple. Apple is not responsible for Garden Companion or its content. Your use of the App must also comply with applicable App Store terms. To the extent required by Apple’s standard App Store terms, Apple and its subsidiaries may be third-party beneficiaries of these Terms.

18. Changes to These Terms

We may update these Terms as Garden Companion evolves. The effective date above will be updated when changes are made.
